A Lasting Power of Attorney is a legal document by which you appoint someone you trust to make decisions for you on matters of health and finances if you are not able to manage yourself.

The document will be prepared and then registered with the Office of the Public Guardian (OPG)

There are two types of Lasting Power of Attorney – one for financial decisions and one for heath and care decisions.

There are two types of Lasting Power of Attorney:

  • Financial Decisions Lasting Power of Attorney
    • This document gives the person of your choice the ability to manage your day to day financial matters including your bank account, investments, paying bills and even selling your house.

      You can include any directions to help guide your Attorneys as to how you want things dealt with (i.e.) business matters.

      Once registered this type of Lasting Power of Attorney can be used straight away so that your chosen Attorneys can help you immediately.
  • Health and Care Decisions Lasting Power of Attorney
    • This document gives the person or your choosing the ability to make decisions about your medical treatment, including life sustaining treatment and social care issues (i.e.) residential care needs.

      This document can only be used when you no longer have the capacity to make decisions regarding your care needs and medical treatment.
  • Enduring Powers of Attorney
    • Enduring Powers of Attorney were the documents used prior to the introduction of Lasting Powers of Attorney to help make decisions about property and money.

      Although new Enduring Powers of Attorney cannot be made, we can assist in the registration of existing ones which were made before the law changed.
  • No Lasting Power of Attorney or Enduring Power of Attorney
    • If you lose mental capacity and have no Lasting Power of Attorney or Enduring Power of Attorney someone will need to get a Court Order to be appointed as “Deputy” to deal with your finances. This is a more expensive and time consuming process.

      The best option is always to plan ahead and ensure that you have the taken the steps necessary to enable your chosen attorney(s) to make decisions and act on your behalf in the event that you are unable to manage yourself.
